These terms are an agreement between you and Haoyuan Tang, an individual developer in Victoria, Australia, who makes Tomrade (“we”, “us”). They cover the Tomrade desktop app, your Tomrade account, and the online services that come with them: account sign-in and email, syncing your preferences and project list, the community plugin directory, and the website, downloads and update feed at tomrade.com (together, “Tomrade”).
By creating an account, or by using Tomrade after you have been shown these terms, you agree to them. If you don’t agree, don’t use Tomrade. Our Privacy Policy explains what we do with personal information and forms part of these terms.
1. Tomrade is a preview
Until version 1.0, Tomrade is in development and testing. Features change between versions, things break, and a release can contain bugs that damage or delete data. Your projects are ordinary folders on your own computer: keep backups of anything that matters, and don’t rely on Tomrade as the only copy of your work.
2. Your account
- You must be at least 13 years old, and old enough to agree to these terms where you live. If you are under 18, or under the age of digital consent in your country, a parent or guardian must agree to these terms for you.
- Give a real email address that you can receive mail at, and keep your password to yourself. You are responsible for what happens under your account.
- One account is for one person. Don’t share it, sell it, or create accounts automatically.
- Tell us at support@tomrade.com if you think someone else has used your account.
3. Your licence to use the app
Tomrade is free of charge. While these terms apply, we give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on computers you own or control, for any lawful purpose, including your work.
Tomrade’s source code, including the plugin SDK and its tooling, is licensed under the Apache License 2.0. Where you use the source code itself, the licence that comes with it governs that use. These terms govern the online services in either case.
Tomrade, the Tomrade name, logo and cat character belong to us. These terms don’t give you any right to use them, except to refer to Tomrade truthfully.
4. Your content stays yours
Your projects, tickets, notes, files, conversations and code (“your content”) belong to you. Tomrade keeps them in folders on your computer, and we don’t receive them unless you send them to us, for example by attaching them to a report.
The few things our services do hold for you, such as your preferences, your list of projects and repositories, plugins you publish, and reports you send, remain yours. You give us permission to store, copy, transmit and display them only as needed to run Tomrade for you and, for plugins you publish, to list and distribute them to other users. That permission ends when you delete them or your account, except for copies other users have already installed and backups we keep for a limited time, as the Privacy Policy describes.
5. Models, agents and other services you connect
Tomrade works with services that other companies provide, which you choose and set up yourself. These include model providers such as DeepSeek, Anthropic or OpenAI-compatible endpoints, coding agents such as Claude Code and Codex, GitHub and other git hosts, web search providers, MCP servers and plugins.
- Your use of each of those services is governed by its own terms and privacy policy, not ours. You need your own account, key or subscription with them, and you pay any fees they charge.
- When you connect one, Tomrade sends it what it needs to do the work you ask for. That can include your tickets, files, code and conversations. We don’t control what those services do with it.
- We are not responsible for those services, their availability, their output, or what they charge you.
6. Agents act on your instructions
Tomrade lets AI agents read and change your files, run commands, create branches and commits, and push to remote repositories, within the permissions you set.
- AI output can be wrong, incomplete, insecure or inappropriate. Review it before you rely on it, publish it, or run it in production.
- You are responsible for the instructions you give, the permissions you grant, and what you do with the results.
- Undo is designed to reverse agent changes, but it can’t recall what has already left your computer, such as a push, an email or a call to another service, and it may not cover every case.
7. Plugins
Plugins can do anything the app can do on your computer. Plugins in the community directory are written and published by other people. We don’t review them. The app shows you the source commit, the declared permissions and a risk analysis before you install one: read them, and install only plugins you trust.
If you publish a plugin:
- it must be open source under a licence that allows us to distribute it, and the published package must be built from the public source you point to;
- you must have the right to publish everything in it;
- it must not be malicious, hide what it does, collect data its users haven’t agreed to, or break the law;
- you are responsible for supporting it and for your users’ data that it handles.
We may hide, remove or remotely disable any plugin, including copies already installed, if we believe it is harmful or breaks these terms. We may also do so for your plugin without notice when users are at risk.
8. Acceptable use
Don’t use Tomrade to:
- break any law, or infringe anyone’s rights, including privacy and intellectual property rights;
- distribute malware, or attack, probe or overload our services or anyone else’s;
- get around rate limits, access controls or the security of our services, or access other people’s accounts or data;
- send spam or abusive content through our services;
- resell or offer our online services to others as your own service.
9. Changes, suspension and ending
We may change, add or remove features, and we may stop providing an online service. For a change that significantly reduces what you can do with your existing data, we’ll give you reasonable notice where we can. Your project folders stay on your computer either way.
You can stop using Tomrade at any time, and delete your account yourself with Delete account… in Settings › Hub. You can also ask us to delete it by writing to support@tomrade.com from the account’s email address.
We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or to protect other users or our services. Unless it would be unlawful or create a risk, we’ll tell you why and give you a chance to respond.
10. Fees
Tomrade is free today. If we introduce paid plans or features, we’ll describe them and their price before you buy, and they’ll come with their own terms. Nothing that is free today becomes paid for you without your agreement.
11. Disclaimers
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by law that can’t lawfully be excluded, including the consumer guarantees under the Australian Consumer Law and the consumer laws of your country (“non-excludable rights”).
Apart from your non-excludable rights, Tomrade is provided “as is” and “as available”. To the extent the law allows, we make no promise that Tomrade will be uninterrupted, error-free, secure, or fit for a particular purpose, or that AI output will be accurate.
12. Limits on our liability
To the extent the law allows:
- we are not liable for indirect or consequential loss, or for loss of profits, revenue, data or goodwill, arising from Tomrade, from services you connect, from plugins, or from actions agents take on your instructions;
- where we are allowed to limit our liability for a failure to comply with a consumer guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again;
- otherwise, our total liability to you for all claims relating to Tomrade is limited to the greater of AUD 100 and the amount you paid us for Tomrade in the 12 months before the claim.
These limits don’t apply to liability for death or personal injury caused by our negligence, for fraud, or to any liability that can’t be limited by law.
13. Changes to these terms
We may update these terms, for example when we add a service or the law changes. We’ll post the new version on this page with its date. If a change is significant, we’ll tell you in the app or by email at least 14 days before it takes effect and ask you to agree to it again. If you don’t agree, you can stop using Tomrade and ask us to delete your account.
14. Law and disputes
These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia. If you live in another country, this doesn’t take away the protection of the mandatory consumer laws of your country, or your right to bring a claim in your local courts.
If you have a problem, write to us first at support@tomrade.com. Most problems are faster to fix that way.
15. General
- These terms and the Privacy Policy are the whole agreement between you and us about Tomrade.
- If a court finds part of these terms unenforceable, the rest still applies.
- If we don’t enforce a term straight away, we haven’t given up the right to enforce it later.
- You may not transfer your rights under these terms. We may transfer ours to someone who takes over Tomrade, provided your rights under these terms aren’t reduced.
- These terms are published in English and Chinese. Both versions have the same effect. If they differ, the English version applies, except where the law where you live requires otherwise.
